Welcome to the NRBVN Information Portal nrbvn.ng. We are a dedicated platform for disseminating information, news, and resources related to NRBVN. Our mission is to provide accurate, timely, and valuable content to our community. Integral to this mission is a profound respect for the intellectual property rights of others, just as we value and protect our own.

This Digital Millennium Copyright Act (DMCA) Policy page outlines our practices and procedures concerning copyright infringement. It is designed to inform you, the user, about how we handle claims of unauthorized use of copyrighted material on our website and the steps you can take if you believe your copyright has been violated.

The Digital Millennium Copyright Act of 1998 (DMCA) provides a legal framework for copyright owners to report alleged infringements to online service providers like nrbvn.ng. In accordance with the DMCA and other applicable laws, we have implemented a policy to terminate, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We also reserve the right to remove or disable access to content claimed to be infringing, without prior notice to the user, and at our sole discretion.

By publishing this policy, we affirm our commitment to responding promptly to legitimate claims of copyright infringement and maintaining the integrity of the creative and intellectual ecosystem that sustains platforms like ours.

Understanding Copyright: A Primer

Before delving into the procedures for filing a notice, it is crucial to understand what copyright protects. Copyright is a form of legal protection granted to the authors of "original works of authorship," including literary, dramatic, musical, artistic, and certain other intellectual works. This protection is available to both published and unpublished works.

On nrbvn.ng, copyrightable content can include, but is not limited to:

  • Written articles, blog posts, and news reports.
  • Photographs, images, and graphics.
  • Videos, audio recordings, and podcasts.
  • Software code, databases, and website layouts.
  • Infographics, charts, and other data visualizations.

It is important to note that copyright protects the expression of an idea, not the idea itself. Facts, names, titles, and short phrases are generally not protected by copyright. Furthermore, the use of copyrighted material for purposes such as criticism, comment, news reporting, teaching, scholarship, or research may be considered "fair use" and not an infringement. The determination of fair use is complex and depends on a balancing of four factors:

  • 1.  The purpose and character of the use (e.g., commercial vs. nonprofit educational).
  • 2.  The nature of the copyrighted work.
  • 3.  The amount and substantiality of the portion used in relation to the copyrighted work as a whole.
  • 4.  The effect of the use upon the potential market for or value of the copyrighted work.

If you are unsure whether your use of another's work constitutes fair use, we strongly recommend consulting with a legal professional before proceeding.

Reporting Copyright Infringement: How to File a DMCA Takedown Notice

If you are a copyright owner, or an agent authorized to act on behalf of the owner, and you believe that your work has been copied and is accessible on nrbvn.ng in a way that constitutes copyright infringement, you may submit a formal notification of claimed infringement (a "DMCA Takedown Notice") to our designated Copyright Agent.

To be effective under the DMCA, your written notification must include the following elements. Please note that under 17 U.S.C. § 512(f), you may be liable for any damages, including costs and attorneys' fees, if you knowingly materially misrepresent that material or activity is infringing. We encourage you to ensure the accuracy of your claim.

Your DMCA Takedown Notice Must Contain:

A. A Physical or Electronic Signature:

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. This can be a scanned physical signature or a valid electronic signature.

B. Identification of the Copyrighted Work:

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site. You must provide enough detail for us to identify the work.

C. Identification of the Infringing Material:

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.

D. Your Contact Information:

Information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and an email address. A P.O. box may not be sufficient.

E. A Statement of Good Faith Belief:

A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

F. A Statement Under Penalty of Perjury:

A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

What Happens After You Submit a Valid Notice?

Upon receipt of a DMCA notice that substantially complies with the above requirements, we will act expeditiously to:

1.  Acknowledge Receipt: We will send an automated or manual acknowledgment email to the provided address.

2.  Review the Claim: Our team will review the notice for completeness and validity.

3. Remove or Disable Access: If the notice is valid, we will remove or disable access to the allegedly infringing material. This action is taken to comply with the law and does not constitute a legal judgment on the merits of the claim.

4. Notify the Affected User: We will make a good-faith effort to contact the user who posted the content, provide them with a copy of the DMCA notice, and inform them that the material has been removed or disabled.

5.  Record the Strike: The incident will be recorded in our internal systems. As per our repeat infringer policy, accounts of users who accumulate multiple valid infringement claims may be terminated.

4. Counter-Notification: If You Believe Your Content Was Removed in Error.

If you are a user who posted material that was removed due to a DMCA takedown notice, and you believe that the removal was a mistake or misidentification, you have the right to file a counter-notification.

The process for filing a counter-notification is also defined by the DMCA. To be effective, your counter-notification must be a written communication provided to our Copyright Agent that includes substantially the following:

Your DMCA Counter-Notification Must Contain:

 Identification of the Removed Material:

Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (the original URL).

C. A Statement Under Penalty of Perjury:

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

D. Your Contact Information:

Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which nrbvn.ng may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

The Counter-Notification Process Explained:

1. Receipt and Review: We will review your counter-notification for completeness.

2. Forwarding to the Original Complainant: If the counter-notification is valid, we will forward it to the original copyright claimant who filed the takedown notice. This email will include your contact information.

3. The 10-14 Day Business Window: The original complainant then has 10 business days (14 total days, excluding weekends and holidays) to notify us that they have filed a legal action seeking a court order to restrain you from engaging in infringing activity related to the content on nrbvn.ng.

4. Restoring the Content: If we do not receive any such notification from the original complainant within this 10-14 business day period, we may, in our sole discretion, replace or restore access to the removed material. This typically occurs between 10 and 14 business days following our receipt of the counter-notice.

Important Warning: Knowingly submitting a false counter-notification can lead to significant legal liability. Be certain that you have a legitimate claim to the material.

5. Policy for Repeat Infringers

In accordance with the DMCA and other applicable laws, nrbvn.ng has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We consider a "repeat infringer" to be any user for whom we have received more than two (2) valid and uncontested DMCA takedown notices regarding content they have posted on our platform.

Our process is as follows:

First Strike: Upon the first valid DMCA notice, the content is removed, and the user is notified. The strike is recorded.

Second Strike: Upon a second valid DMCA notice, the user's account may be temporarily suspended, and a final warning is issued. A more thorough review of the user's account may be conducted.

Third Strike: A third valid DMCA notice will result in the permanent termination of the user's account and a ban from creating new accounts on nrbvn.ng.

We reserve the right to terminate a user's account after a single infringement in egregious circumstances, at our sole discretion.

6. Modifications to This Policy

nrbvn.ng reserves the right to modify, amend, or change this DMCA Policy at any time and at our sole discretion. The "Last Updated" date at the top of this page will indicate when the latest revisions were made. 8. Frequently Asked Questions (FAQ)

Q1: I found my image on your site, but it's credited to me. Is this an infringement?

A: Crediting the creator is a good practice but does not automatically grant a license to use the work. If you did not grant permission for the use (through a license, Creative Commons, etc.), it may still be an infringement. However, if the use qualifies as "fair use" (e.g., for commentary or criticism), it may be permissible. The context of the use on our site is key.

Q2: How long does it take to process a DMCA notice?

A: We strive to act expeditiously on all valid DMCA notices. You can typically expect an acknowledgment within 24-48 hours and action on the content within 1-3 business days, barring exceptional circumstances.

Q3: What if I don't own the copyright but want to report an infringement?

A: The DMCA process is specifically for copyright owners or their authorized agents. If you are not the owner, you can inform the copyright owner of the potential infringement and suggest they file a DMCA notice.

Q4: My content was removed, but I have a license to use it. What should I do?

A: File a counter-notification as described in Section 4. In your statement, you can clarify that you have a license. Be prepared for the original complainant to potentially take legal action, as the counter-notification process will inform them of your claim.

Q5: Do you process DMCA notices from outside the United States?

A: Yes. While the DMCA is U.S. law, we respect international copyright norms and will process notices that substantially comply with the DMCA requirements from copyright owners worldwide.

Q6: What about trademarks or other intellectual property?

A: This policy and the DMCA process specifically address copyright infringement. Claims of trademark infringement, defamation, or other legal violations are handled through a different process. Please contact us at nrbvn.ng@gmmail.com for such matters.

Q7: Can I modify the DMCA notice template I found online?

A: Yes, templates are a good starting point, but you must ensure that the final notice you send contains all six required elements listed in Section 3 of this policy. An incomplete notice will delay the process.

9. Conclusion

At nrbvn.ng, we are committed to fostering a respectful and lawful online environment. We believe that protecting intellectual property rights is fundamental to encouraging creativity, innovation, and the sharing of knowledge. This DMCA Policy is a cornerstone of that commitment.

We thank you for your cooperation and understanding. By working together, we can ensure that nrbvn.ng remains a trusted and valuable resource for all.
